Section 11: Remote Online Service Provider Functions

Online Notaries Public must use 3rd party service providers for AV technology, identify proofing, and credential analysis. The Online Notary Public candidate must inform the State which RON Service Provider(s) they will use for these services when registering to become an Online Notary Public. The RON Service Provider typically performs the identity proofing and credential analysis prior to initiating the audio-visual conference between the Online Notary Public, the Principal, and any witnesses. The RON Service Provider should provide electronic copies of the government-issued ID used for authentication so that the Online Notary Public may visually inspect them and compare the photo to the person(s) in the online session.

The RON Service Provider will create an electronic file of the online notarization session. These may be provided to the Online Notary Public for storage, or optionally, the RON Service Provider may store the electronic file.

If the item to be notarized is a Will, trust, health care directive, waiver of spousal rights, or power of attorney for financial transactions, the RON Service Provider must ask a series of questions of the Principal as defined in section 9. This must be done prior to the Online Notary Public beginning the notarization process. The RON Service Provider may only store the AV recording of a Will if they are recognized as a qualified custodian.
